Federal Judge Orders Release of Kilmar Abrego Garcia from ICE Detention
A court has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without legal authority.
"Since Abrego Garcia's return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her order.
The case stems from a mistaken removal to El Salvador earlier this year, which the government later admitted was an mistake. Following his repatriation to the United States to answer human smuggling charges, he was detained in immigration custody.
In her decision, the judge noted that the authorities does not have a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
Context of the Legal Challenge
The legal challenge center on conflicting claims. Whereas the Trump administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he categorically denies this claim.
He has also entered a not guilty plea to the smuggling charges, which are part of a separate criminal case in the state of Tennessee.
Terms of Freedom
The judge, who was overseeing his challenge to removal in a Maryland district court, determined that he must now comply with the terms of his release from jail in Tennessee. This order effectively transfers his monitoring to the Tennessee court.
This decision represents a notable turn in a complicated immigration case featuring allegations of wrongful detention and disputed criminal associations.
